Is Plant Medicine Legal in California? (2026 Update)

A clear, honest look at the legal status of plant medicines in California as of 2026 — and how Sacred Healing operates within that landscape.

This is one of the most frequent questions we receive in discovery calls: "Is this legal? Am I going to get in trouble?"

The answer requires nuance, because the legal landscape is shifting and varies significantly by substance and context. Here is where things stand as of 2026.

The Federal Baseline

Under federal law in the United States, psilocybin, ayahuasca, mescaline (San Pedro), and 5-MeO-DMT (Bufo) are all Schedule I substances. That means the federal government classifies them as having no accepted medical use and a high potential for abuse — a classification most modern researchers consider scientifically outdated.

Schedule I status means possession and distribution are federal crimes. In practice, federal enforcement of personal-use psychedelic cases has been rare for decades, and even rarer in states and cities that have decriminalized these substances.

California, City by City

California has not statewide-decriminalized plant medicines, but several cities have:

• Oakland — decriminalized entheogenic plants and fungi in 2019

• Santa Cruz — decriminalized in 2020

• San Francisco — decriminalized in 2022

• Berkeley — decriminalized in 2023

• Arcata, Eureka — decriminalized in 2023

Decriminalization is not legalization. It means local police treat possession of small amounts as the lowest law-enforcement priority. The substances remain federally illegal.

In jurisdictions that have not decriminalized — including most of Southern California and the area around Joshua Tree — these substances remain federally illegal and state-level criminal.

The Religious Freedom Framework

There is a separate path: religious and spiritual exemption.

Under the federal Religious Freedom Restoration Act (RFRA) and parallel state laws, sincere religious use of certain entheogenic substances has been recognized in specific contexts. The most well-known examples:

• The União do Vegetal (UDV) — federally recognized to use ayahuasca in religious ceremonies

• Santo Daime — federally recognized in some jurisdictions

• The Native American Church — federally recognized to use peyote ceremonially

The RFRA framework is narrow, specific, and has been tested in court many times. Sacred Healing operates within a religious and spiritual exemption framework. We do not promote our work as a way around the law. We hold it as sacred ceremonial practice.

If you are participating in ceremony, the legal posture matters less than the integrity of the work. The medicine deserves reverence regardless of legal status.

Kambo Is the Exception

Of the medicines we hold, Kambo is the only one that is federally legal. The secretion is not a controlled substance — it is a traditional animal-based medicine without psychoactive scheduling. Kambo practitioners operate legally throughout the United States, including in California.

This is why Kambo is often a first ceremony for people who want to experience traditional plant (and animal) medicine work in a fully legal context.

Looking Forward: Federal and State Changes Coming

The legal landscape is moving:

• Oregon — legalized supervised psilocybin services in 2020 (Measure 109)

• Colorado — legalized supervised psilocybin services and decriminalized possession in 2022 (Proposition 122)

• FDA Breakthrough Therapy — psilocybin holds Breakthrough Therapy designation for treatment-resistant depression

• California — multiple decriminalization and regulated-access bills have been introduced; none have yet become law

Our expectation is that California will move toward some form of regulated psilocybin or broader plant medicine access in the next few years. We support thoughtful regulation that honors both safety and the ceremonial tradition these medicines come from.
